SERIOUS PERSONAL INJURY

Ethan Vessels is the among the preeminent personal injury and wrongful death attorneys in Southeast Ohio and Northern West Virginia. Ethan has recovered over $100 million in verdicts and settlements in the last ten years. Many clients who have come into our office suffering from a serious personal injury say, “We are not the type to sue. We don’t believe in suing people. But…” When confronted with medical bills, lost time from work, and the nagging pain of injury, we are often left with no choice.

The media has conditioned us to believe that those who seek compensation for injuries are greedy or litigious. This is simply untrue and unfair. If you have been injured because of the negligence of another, you are entitled to be fairly compensated for your injuries. If you face the tragedy of losing a husband, wife, parent, or child because of a negligent act, you may be entitled to recover compensation for the loss. Many of us face the misfortune of suffering an injury caused by negligence. In most circumstances, these injuries are caused by the lack of due care, rather than through intentional conduct. These injuries often occur because of auto accidents, negligently maintained property, or defective products, among many other causes. Although rare, some also suffer injury as a result of negligence of doctors and hospitals.

Those injured may incur medical bills, lost time at work, and pain and suffering from the injury. Some injuries cause permanent impairment, permanent diminished earning capacity, or even death. Liability insurance covers many situations in which persons suffer injury or death due to the negligence of others–whether through automobile liability policies, commercial liability and umbrella policies, or homeowner’s policies. Successfully pursuing a personal injury claim requires knowledge of how liability insurers operate.

There are many details involved in a personal injury claim. Who is the liability insurer for the at-fault party? Is there other insurance available through the injured person’s insurer, such as uninsured or underinsured motorist coverage? How long does the statute of limitations extend and when does it begin to run? What is the value of the claim? How much should be demanded to settle? Do any family members have a separate claim? Is the injured person required to reimburse his or her health insurer? Is there also property damage that accompanies the injury? Will there be future medical bills? Are there multiple defendants?

RESULTS MATTER

It is important that your attorney is able, and willing, to try your case before a jury. Many lawyers advertise for personal injury claims, yet routinely settle cases for much less than the case merits–unwilling to try the case in court. ETHAN TRIES CASES. Negotiating a fair settlement is the goal, but if the opposing party is unwilling to offer the fair value of the claim, we will take the matter before a jury in order to obtain the fair result. Some results:

  • Settlement of $650,000 for back injuries suffered in a truck accident.
  • Settlement of $500,000 for back and leg injuries in a trucking accident.
  • Settlement of $230,000 for fractured shoulder requiring surgery.
  • Settlement exceeding $1 million in an industrial accident.
  • Settlement exceeding $1.2 million in an industrial accident.
  • Verdict of $516,000 for back injuries suffered in a highway collision.
  • Verdict of $287,500 for a mild traumatic brain injury.

Each case resolves based on the facts of each case and, of course, prior verdicts or settlements should not be construed as any promise or warranty regarding the settlement value of a future claim.

You may be entitled to financial compensation for your injuries, including costs for medical care and pain and suffering. Truck accidents often cause severe injuries and property damage. Truck accidents also bring questions not often asked in car accident cases. For instance, was the driver of the truck working at the time?
